1. Who We Are

We are Pic2Art, a small family-run business established in the UK providing design, printing and related services in the Great Britain.

We provide design, printing and related services (the Services) through our website at www.pic2art.co.uk, enabling you to upload photographs, text, and other content (Customer Content) to create customised products (Products).

2. Applicability of These Terms

These Terms & Conditions apply to all use of our website and Services and to the purchase of Products delivered within the United Kingdom. By using our Services, you agree to these Terms & Conditions.

These Terms do not limit or exclude your statutory consumer rights under UK law.

3. Changes

We may amend these Terms from time to time. The Terms in place at the time you place an order will govern that order.

4. Site Content

All content on our website (designs, templates, software, etc.) remains our property or that of our licensors. You may only use it to create Products for personal or internal business use.

5. Customer Content

You retain ownership of Customer Content, but by uploading it, you grant us a licence to use it solely for providing the Services. You must ensure your Content is lawful, does not infringe third-party rights, and complies with UK laws (including copyright and defamation laws).

We may refuse or remove unlawful or inappropriate content.

Customers are fully responsible for providing images that meet the required quality and size specifications. Any issues related to low resolution, incorrect dimensions, or poor image clarity may affect the final output, and we are not liable for results derived from images that do not meet the provided guidelines.

6. Price & Payment

Prices are shown in GBP and include VAT. Delivery charges are additional and displayed before purchase. We use Woopayment to process payments.

Payment must be made using an approved payment method.

7. Orders & Delivery

• Orders for customised Products are subject to availability.
• Delivery is available across mainland UK and Northern Ireland.
• Risk passes to you upon delivery.
• Delivery times are estimates only.

• Orders for Diamond Art Kits will take 3–4 business days with Next Day Delivery, and 5–7 business days with Express Delivery, due to longer processing times.
• For Next-Day and Express delivery, orders must be placed before 12:00 PM, Monday to Thursday (excluding Bank Holidays).
• Orders placed on Friday before 12:00 PM for Next-Day delivery will be delivered on Monday, or on the next business day if Monday is a bank or public holiday.
• The above charges and shipping terms apply to UK mainland deliveries only. For information about deliveries outside the UK mainland, please contact us.

8. Returns & Refunds

• Personalised Products: No cancellation rights once your order is placed (Consumer Contracts Regulations 2013).
• If your Product is defective, you may request a replacement or refund within 30 days of receipt. After this, your rights continue under the Consumer Rights Act 2015.
• Non-personalised Products: You may cancel within 14 days of receipt, return the Product at your own cost, and receive a refund.
• If the product is delivered damaged, it must be reported within 48 hours of delivery.
• All print sizes may vary by 3-5%. Customers must provide the image of the correct size and resolution for the ordered dimensions. We are not responsible for resizing, adjustments or achieving exact dimensions. Variations within tolerance are accepted and not eligible for reprints or refunds.

9. Security & Accounts

You must keep your account secure. You are responsible for all activity on your account.

10. Indemnity

If you obtain our Services for personal use or on behalf of a company, you and that company must indemnify us against claims arising from unlawful use or breach of these Terms.

11. Disclaimer

The Site and Services are provided on an “as is” basis. We do not guarantee uninterrupted service.

12. Liability

• We are not liable for poor image quality when you provide the content.
• We are not liable for indirect or consequential losses (loss of profit, data, etc.).
• Our liability is limited to the amount paid for the relevant Products.
• We do not exclude liability for death, personal injury, fraud, or any rights you cannot waive under UK law.

13. Assignment

You may not assign your rights under these Terms. We may transfer our rights and obligations, provided this does not affect your statutory rights.

14. Governing Law

These Terms are governed by English law. You may bring claims in your local UK court or the courts of England and Wales.

15. Privacy

We process your data in accordance with the UK GDPR and the Data Protection Act 2018. See our Privacy Policy and Cookie Policy.
